Additional terms and conditions: The PURCHASER agrees to insure a suitable and safe place for the PERFORMER to appear and perform. Commencement of this event, together with the physical delivery of this contract is deemed to be an acceptance of all terms by the PURCHASER. Any comments or attached contract riders are hereby made part of this contract. The PERFORMER's obligation to perform is subject to detention by sickness, accidents, inability to perform, means of transportation, acts of God, or any other condition beyond the PERFORMER's control. In the unlikely event that the PERFORMER is unable to appear as agreed, the PERFORMER's liability will be held to providing a substitute of equal merit or scheduling a similar performance at another mutually agreed upon date if either is possible, but shall not extend to any damages sustained by failure of the PERFORMER to appear, or by the inability to acquire a substitute. The PURCHASER is liable for full payment in the event that the time and/or location of the performance, as stated on this contract, is incorrect resulting in a missed performance by the PERFORMER through no fault of his own. Events postponed due to inclement weather must be rescheduled and the deposit received with this contract for the performance will be applied to the subsequent performance, and will not be returned unless agreed upon by both parties. The deposit for an event will not be returned unless the PERFORMER is unable to attend the event scheduled on this contract. If the event needs to be rescheduled, no further contract is necessary to maintain this agreement, if both parties verbally agree to an appearance on the new date. This contract shall not be voided without the verbal agreement of both parties.
